Seminar on FIDIC Contracts

We are happy to present another FIDIC Seminar to educate and capacitate clients, project implementation agencies, procurement and project management consultants, built environment professionals, contractors, and lawyers with knowledge about FIDIC Contracts generally and insights about the 2017 FIDIC editions specifically.

This November 2018 Seminar is structured in two parts. The first part is a 1-day Introductory overview of FIDIC Contracts designed for new users and people wishing to acquire a basic understanding of FIDIC Contracts. The second part is a 2-day Seminar based on the 2017 editions of the FIDIC Suite of Contracts (including a comparison of its provisions with the 1999 editions) to provide an in-depth understanding of the recent FIDIC editions published in 2017.

We are privileged to have a leading international trainer and affiliate member of FIDIC to deliver this Seminar. The Seminar will include case studies which will enable participants to acquire a practical knowledge of contracting arrangements and conditions under the FIDIC ‘rainbow suite’ of contracts which are widely used for construction and engineering projects involving international partners.

COENRAAD SNYMAN

Principal at Coen Snyman International & Affiliate member of FIDIC

Coenraad Snyman has delivered 100s of training seminars on FIDIC Contracts and received excellent feedback from participants. He is one of 69 affiliate individual members of FIDIC around the world. Coenraad is a specialist in the procurement of contracts in the engineering, construction and mining sector, in contract administration, claims and dispute resolution. He has practical experience in the use of most construction and engineering contracts. He is sought after and is often used as a trainer and facilitator on FIDIC and NEC forms of contract internationally. He was, until September 2012, employed as a senior contract specialist at AngloGold Ashanti, the 3rd largest gold producer in the world. At AGA he was involved with the procurement and management of EPC and EPCM contracts on capital expansion projects situated in Namibia, Mali, Tanzania, Ghana, Guinea and the Democratic Republic of the Congo (DRC). Prior to joining AngloGold Ashanti, Coenraad was a Director of Turner & Townsend and acted as head of their Contract Services division in Africa. Coenraad is an admitted attorney in South Africa. He practises as an independent consultant to the mining, engineering and construction industry, provides training in the procurement and use of FIDIC, NEC, GCC and JBCC contracts and accepts appointment as an adjudicator, arbitrator or DAB member. He acts for and on behalf of parties in disputes but is often also consulted to advise clients, during the execution of the works, on ways in which to avoid and/or to resolve or settle matters prior to them escalating into formal disputes.  

 

WHAT WE WILL COVER

SEMINAR 1 (5th NOVEMBER 2018)

INTRODUCTORY OVERVIEW OF THE FIDIC SUITE OF CONTRACTS

This 1-day Seminar is designed for new users of FIDIC Contracts and those wishing to learn about the FIDIC suite of contracts. Attend this workshop to acquire a basic knowledge of the main forms of contract comprising the FIDIC suite of contracts; and contracting arrangements and conditions under different FIDIC Contract Books. An overview of all of the following contracts will be provided:

  1. Conditions of contract for construction (Red Book)
  2. Conditions of contract for Plant and Design-Build (Yellow Book)
  3. Conditions of contract for Engineering, Procurement and Construction (EPC)/Turnkey Contract (Silver Book)
  4. MDB Harmonized version (Pink Book)
  5. Conditions of contract for Plant, Build and Operate Projects (Gold Book)
  6. Conditions of subcontract for construction
  7. Client/Consultant Model Services Agreement (White Book)

Emphasis will be placed on the criteria and principles to use in order to select the most appropriate contract for your project. Focus will also be placed on preparing the various contract documents properly and highlighting the advantages of using a form of contract such as FIDIC rather than a bespoke, mix-and match or a cut-and-paste boilerplate contract.

 

SEMINAR 2 (6th and 7th NOVEMBER 2018)

2-DAY SEMINAR ON THE 2017 EDITIONS OF THE FIDIC SUITE OF CONTRACTS (INCLUDING A COMPARISON OF ITS PROVISIONS WITH THE 1999 EDITIONS)

This 2-day Seminar will provide participants with knowledge and insights about the 2017 editions of the FIDIC contracts and the key changes. Participants will acquire a practical knowledge of contracting arrangements and conditions under the new FIDIC ‘rainbow suite’ of contracts (including a comparison of its provisions with the 1999 editions).

We will dig deeper into the various clauses and emphasis will be placed on proper procedures, effective management and administration, variations, claims for additional time and cost, the engineer’s determinations, dealing with breach of contract, available remedies, termination and handling or avoiding disputes. Specific matters to be dealt with include:

  • Putting the tender and contract together
  • Design
  • Role of the Engineer in administering the contract
  • Payment provisions
  • Variations
  • Contractor’s claims for a revision of the Completion Date and/or for the payment of additional Cost; Claims by the Employer
  • Quality control
  • Dispute resolution and claims
